TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the website located at elevatedmarketing.space (the "Site") and any services purchased from AnnaLisa Johnson, doing business as Elevated Marketing Space ("Company," "we," "us," or "our"), based in McKinney, Texas.
By using the Site, booking a consultation, or purchasing any service from us, you agree to be bound by these Terms.
1. SERVICES
We provide marketing and web-related services, including but not limited to website design, landing page creation, CRM setup, marketing automation, hosting and maintenance, custom digital solutions, and paid systems consultation and training sessions.
Specific project scope, deliverables, and pricing for custom projects are outlined in a separate signed client contract or proposal, which governs that engagement in addition to these Terms.
2. SERVICE AREA
We currently accept clients located within the United States only.
3. BOOKING AND PAYMENT
Some services, including systems consultations, require payment or a deposit in advance of scheduling. Payments and bookings are processed through our booking platform, GoHighLevel. By submitting payment, you authorize us to charge the amount shown at checkout for the selected service.
For custom client projects, payment terms (including deposits, milestone payments, and final payment) are outlined in your individual project contract.
4. REFUND POLICY
All payments and deposits are non-refundable, except in the following circumstances:
- The project or engagement must be stopped or cannot be completed due to circumstances on our end; or
- The deliverables outlined in your signed project contract were not met.
Refunds, when applicable, will be evaluated based on the terms of your individual signed contract and the work completed at the time of cancellation. Simply changing your mind, being unavailable for scheduled sessions, or dissatisfaction with subjective creative preferences (where deliverables otherwise meet the agreed contract scope) does not qualify for a refund.
5. CLIENT RESPONSIBILITIES
To provide services effectively, we may require timely information, access, feedback, or approvals from you. Delays in providing these may impact project timelines and are not the responsibility of Elevated Marketing Space.
6. INTELLECTUAL PROPERTY
Unless otherwise agreed in writing or specified in a separate client contract, Elevated Marketing Space retains ownership of any proprietary templates, frameworks, systems, or training materials used or provided during a consultation or project. Final client-specific deliverables (such as a completed website built for you) are owned by the client upon full payment, unless your signed contract states otherwise.
Any strategy documents, training recordings, or planning materials provided as part of a paid consultation are for your internal business use only and may not be resold, redistributed, or used to train or compete directly against Elevated Marketing Space.
7. CONFIDENTIALITY
We treat information shared with us about your business as confidential and will not disclose it to third parties except as necessary to perform the services or as required by law.
8. NO GUARANTEE OF RESULTS
While we provide our professional expertise, strategy, and training to the best of our ability, we do not guarantee specific business results, revenue, lead volume, or outcomes from any service, consultation, or training provided, as these depend on many factors outside our control, including your own implementation.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Elevated Marketing Space shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Site or services. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
10. TERMINATION
We reserve the right to decline service, pause an engagement, or terminate a working relationship at our discretion, including in cases of non-payment, abusive conduct, or failure to meet client responsibilities outlined in a signed contract.
11. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Collin County, Texas.
12. CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
